Please review these terms and conditions carefully before using our website. Your use of the MyAirline website indicates your agreement to be bound by these terms and conditions.

These terms and conditions also then apply when you use the MyAirline website or areas of it from other internet sites which provide access to the MyAirline website in full or in part.

2. Proprietary rights

All trademark rights, copyright, database rights and other intellectual property rights to the contents of the MyAirline website, (as well as the organisation and layout of the website), together with the underlying software code, rest with MyAirline, tc.solutions or its licensors. You may not, either in whole or in part, copy, modify, distribute or use or reproduce in other form contents of the MyAirline website, or the underlying software code, without the prior written consent of MyAirline and tc.solutions.

3. Permissible use

All MyAirline website online services (including those provided by tc.solution) are provided solely for the purpose of enabling you to request offers for products and services relating to your travel, make legitimate orders, legitimately change and cancel orders, use our online check-in or transact other business with suppliers. You may only use the website in accordance with these terms and conditions and for the legally permitted purposes described above. In particular, you indicate your agreement to the following:

  • You may not use the MyAirline-website in a manner which causes an infringement of the proprietary rights of others
  • You may not utilise any devices, mechanisms, software or other scripts which could interfere with the working of the MyAirline website. This also includes uploading files infected with viruses.
  • You may not take any action which could result in an unreasonable or excessive load on the tc.solutions infrastructure.
  • You may not block, overwrite or modify any MyAirline-generated content or in other way disrupt the MyAirline website.
  • You may not reproduce information from the MyAirline website for commercial purposes. This also includes providing prices for MyAirline flights and ancillary services on another website or another online server. In particular, you may not copy, distribute, in other way use or reproduce discarded content from the MyAirline website with the help of 'robots', other search machine technologies or through other automatic mechanisms.
  • You may not acquire, or attempt to acquire, any unauthorised access to any of our networks, by whatever means.
  • You may not make any unauthorised, false or fraudulent orders, in particular any orders which are paid for with credit cards or bank account details belonging to a third party who has not consented to this.

4. Consequences of improper use

Without prejudice to our other rights (irrespective of whether they are based on law or other regulations), we reserve the right to cancel your order without reference to you and/or to deny you access to the MyAirline website if you have contravened these terms and conditions.

5. Changes to this website

We reserve the right, at any time and without prior notice, to undertake improvements or modifications in respect of the information, services, products and other contents of the MyAirline website. We further reserve the right to modify these terms and conditions at any time. Any such modification shall be effective immediately upon posting the amended terms and conditions on the MyAirline website. Accordingly, your continued access or use of the MyAirline website is deemed to be your acceptance of the modified terms and conditions.

This website may contain links or references to other websites which are not operated by MyAirline or tc.solutions. Unless otherwise specified, we do not endorse any of these other websites and expressly disassociate ourselves herewith from all contents of these sites, and expressly declare them as out of scope of our data protection policy. This declaration applies to all links to external sites covered by MyAirline and to all the contents of these sites to which these links lead. We reserve the right to make the link to other websites contingent upon our express written consent and to withdraw our consent to a link at any time.

MyAirline and tc.solutions accept no liability whatsoever for the topicality, accuracy, completeness or quality of the information provided by third parties (e.g. co-operation partners, tour operators, airport and ancillary service providers). Claims for liability against MyAirline and tc.solutions relating to damages of a material or non-material kind, which were caused by usage or non-usage of the information presented, are precluded, provided that there is no negligence or fraudulent misrepresentation on MyAirline’s or tc.solutions’ part.

8. Storage of internet session information

When you visit the MyAirline website, our web server automatically saves the IP-address of your Internet Service Provider, the website you are visiting us from, the web pages that you visit on our site, the inputs you are providing on these pages, and the content we are providing to you, as well as the date and duration of your visit. In the event of infringements of these terms and conditions, we will keep the stored session information to use in pursuance of civil law claims and for the resolution of criminal offences.

9. Encrypted communication via the internet (SSL)

To ensure the highest possible security for the transmission of your data between your web browser and our internet system we use the Secure Socket Layer (SSL) encrypting technology. SSL enables an encrypted communication respectively transfer of documents via the internet between web browser and web server. The URL of a website with SSL connection to your browser starts with https://.

We do everything to secure your personal data: any personal information collected during visits to our websites is processed in accordance with the provisions of international laws, specifically EU General Data Protection Regulation (GDPR 2016/679).

MyAirline respects your personal privacy.

Collection and processing of personal data

MyAirline stores your personal information if you provide it to us yourself, for example, during registration, as part of a survey or competition, or during contractual transactions (e.g. booking a flight). Furthermore, MyAirline analyses traffic on its website in order to understand our customers' requirements and, based on these, to continually improve our site. For this reason, we store the IP address of a visitor’s Internet Service Provider as standard. The IP address is not linked to a specific person. Only anonymous, aggregate data is evaluated for statistical purposes during web analysis. Data from individual uses of our website is stored for error analysis. This information is used solely for correcting errors and is deleted after a two-week storage deadline. MyAirline uses cookies to track visitor preferences and to improve the design of its websites accordingly. When a rating is submitted for a website, anonymised and non-personal data will be forwarded to a third-party supplier.

Use of the web analysis tool Google Analytics

MyAirline carries out access measurements on MyAirline websites using the web analysis tool Google Analytics. Cookies are used for measurement and the access data is collected in an anonymised form so that no connection can be made to a user. In particular this is done by anonymising the IP address. The information produced about the use of the websites is transferred in anonymised form to the statistics server that is operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google Analytics”) in the United States. Only authorised persons have access to this anonymised data.

Usage-based online advertising

Limitations on use and disclosure of personal data

MyAirline will process and use your personal data only in connection with services related to the website myairline.com and the MyAirline newsletter. This enables us to offer you a customized service and/or can also save you from having to enter the same information twice. We only utilize as much information as is necessary. We will not share your personal data with third parties. Any partner services offered on myairline.com are booked directly with these partners. You will be advised of this accordingly. Some of our services give you the opportunity to store personal information (e.g. FAQ). Such information will only be used to respond to your current inquiry. After your inquiry is closed, this information will not be retained without requesting your permission to do so. If Government agencies or authorities ask us to collect or share personal data, we will do so only within the appropriate legal frameworks. We require our employees, suppliers and partners to maintain confidentiality and data secrecy in accordance with international laws and regulations. All airlines are required by law to provide the US Customs and Border Protection with the flight and reservation details of every traveller entering the USA. Opt-in/opt-out

We would like to use your data to tell you about our products and services and those of our partners, and also to conduct occasional surveys. You decide whether or not you would like to be contacted by us. If you change your mind, you can alter your preferences at any time in the 'Newsletter and SMS services' section under 'My Account' > 'My Profile'.

Accessing personal data

If requested, MyAirline will confirm whether we store personal data about you and what this data is. Despite our best efforts to ensure that this stored data is accurate and up-to-date, it may be incorrect. If it is, we will correct it on request. You can update most of your personal details yourself at any time under 'My Account' > 'My Profile'. If changes occur to your personal details, please update your profile as soon as possible.

Data security

MyAirline uses technical and organizational security measures to protect the data we hold about you against accidental or deliberate manipulation, loss, deletion or unauthorized access. Our security measures are being improved continuously as new technology develops.

Privacy statement on crashlytics (only relevant for usage of the MyAirline mobile app)

MyAirline is using a tool crashlytics in this app. This is used for real-time crash reports with detailed information on the code and device. This is only done in order to improve the maintenance and stabilization of the app. No personal data is transferred.

11. Personalised user experience (Cookies)

So-called “cookies” are used for personalization of information on our website:

To ensure that our service is as user-friendly as possible we use so-called cookies and web beacons.

A “cookie” is a small text file which a webserver (for example the www.myairline.com webserver) sends to your browser when you visit a website. So-called “session cookies” expire at the end of the browser session and can capture your activities during the browser session. In contrast to these, there are “permanent cookies” which are saved on your terminal and these are able to capture your settings or activities on multiple websites.

Web beacons are small graphic data (also known as ‘Pixel Tags’ or ‘Clear GIFs’), which can be included in our websites, apps, applications and newsletters and are usually used in combination with cookies to identify users and user behaviour. The above mentioned statements about cookies apply accordingly for web beacons; web beacons will in particular not be used in case you objected to the use of the relevant cookie.

Cookies pose no risk to your computer, as they are simply text files and not executable programs.

The cookies on the MyAirline website (myairline.com) are used both to ensure convenient browsing and for market research and advertising purposes, as well as to collect statistics on use. We also use cookies for the purpose of web tracking, and they form the basis of your personalised content.

Besides so-called “session cookies” which are deleted when you end your browser session, we put in place permanent cookies. Cookies are stored until deleted by the user. No personal data is stored in the cookies used by us.

It depends on your browser’s settings as to whether the cookie file is stored or deleted. If the file is stored, our webserver can recognise your terminal. Next time you visit the site or when you switch between functions requiring you to enter a password, the cookie can save you re-entering information. This is how cookies make it easier for you to use websites requiring user input. 12. MyAirline Profile privacy statement

With the following MyAirline Profile Data Privacy Statement ("Data Privacy Statement"), we wish to explain which of your personal data we collect when you register with MyAirline Profile for the MyPoints programme, and how we process and deploy your data when you use MyAirline Profile. The service is also subject to our other statements and information on handling personal data. Please find these at MyAirline Privacy.

Collection of personal data and connection with the MyPoints programme:

When you register with MyAirline Profile, we only ask for your email address as a mandatory element.

In order to make full use of the benefits of MyAirline Profile, you can supplement your MyAirline Profile to include other voluntary particulars. These may be, e.g., your name, gender, address, date of birth, further contact data and your mobile-phone number or your flight preferences, like seat or meal preferences.

Subject to your previously given voluntary consent, you can also specify by which digital means (e.g. email, SMS or phone) we may communicate with you.

If you are a member in the MyPoints programme (“MyPoints”), we ask you to link your MyAirline Profile to the MyPoints programme. This is the only way for us to ensure that you receive merely the communication you have requested and/or that your data is only used in the requested framework. With the link-up of the profile and programme, your data is kept in one central place; particulars of this may be found in the MyAirline Profile Terms of Use and below under the section "Consequences of connecting the MyAirline Profile with the MyPoints programme".

Use of personal data and earmarking

With MyAirline Profile, we wish to bring you a travel experience that is personalised and tailored to your own needs and expectations from your very first visit to our page and beyond the end of your journey.

It is for this purpose, and also to rule out any unnecessary contacting and unsolicited advertising, and in order to improve our product, that we collect and process the personal data you provide within the scope of your registering and using MyAirline Profile. This we do with the aim of supplying individualised information and offers irrespective of your chosen communication channel, e.g. via our websites, by app or email.

Individualised information and offers, incl advertising

By registering your MyAirline Profile, you give your consent that we may collate and analyse your consumption and usage behaviour data to let you have relevant and personalised information and offers tailored to your interests.

This may happen on various occasions. When you launch a booking search on one of our websites, for instance, we can now adapt the result to suit your search interests. Or we can make your booking easier for you by letting you have forms and blanks that are pre-filled with your data and past preferences. Or you will receive before, during or after your flight with us perfect-fit relevant information, e.g. gate changes, recommendations for specific flights, information on baggage conditions as well as advertising and non-advertising offers, e.g. seat upgrades, etc.

By 'collating' your consumption and usage data we mean that the data we collect within the scope of your using MyAirline Profile are linked to other data legitimately collected and centrally stored by the MyAirline. These may be, e.g., your master and programme data under the MyPoints programme or booking data or your consumption and behaviour data from the MyAirline. Any further personal data from other sources – like websites operated by third parties – will only be collected, processed and used to produce personalised information if you have given your consent to such third parties.

Digital communication

We only wish to provide you with particulars, recommendations and offers that really interest you. You can give your consent when registering or later in your MyAirline Profile to receiving digital advertising communications. By 'digital communication' we mean non-analogue communication, like contact by email, phone, SMS or instant messaging, for example.

If you give your consent when registering, this extends to communications from MyAirline. The content of the communications may be information and offers from the MyAirline Airlines, like newsletters, market research, individualised offers or offers from partner companies, i.e. companies with which MyAirline cooperates to let you have further tailored-to-suit offers. In your profile, you can also revoke your consent to receiving digital communications, also for specific areas (e.g. only the newsletter or only the phone).

Choice

You decide to what extent you wish to be informed by us and which data we receive from you and may use.

To this end, you may set certain aspects of the data use in your MyAirline Profile. There, for example, you can select or deselect certain newsletters, and enter further personal data.

If you no longer wish your consumption and usage behaviour data to be collated and analysed, this can be done at any time by deleting your MyAirline Profile. Consequently, your personal data collected while using the MyAirline Profile will be deleted.

You can yourself delete specific data you have provided within your MyAirline Profile. We also delete your data if you do not confirm your registration within the term set in the confirmation email or if you have a confirmation email sent to you more than three times without confirming it.

We may possibly have to store your data in each of the above cases until expiry of certain preservation duties and periods set by lawmakers or supervisory authorities. After that, the data concerned are routinely deleted.

Consequences of linking a MyAirline Profile with a MyPoints account

MyAirline Profile and the MyPoints programme are both services of MyAirline that provide you with various features and offers.

We thrive to maintain a “single source of truth” and save you the trouble of having to update multiple profiles and accounts, therefore we ask you to link the two entities (cf. MyAirline Profile Terms of Use). This is in order, e.g. to rule out your receiving recommendations, offers or adverts from MyPoints although you stated in your MyAirline Profile that you do not wish them.

MyAirline Profile is the “single source of truth” for the MyPoints programme in the following areas:

  • Master data (e.g. name, first name, date of birth, address, phone number) that you supplied.
  • Your preference data, e.g. your seat or meal preference data.
  • Your payment data, e.g. your credit card information, which you wish us to store via a secure payment service provider.
  • Your order overview and history.
  • Your communication preferences, i.e. your consent to receiving digital communications on individualised offers of MyAirline and its partner companies and/or MyPoints' partner companies and any further communication components.

Transmission of personal data

Data are not transmitted to any third parties outside the MyAirline.

Data security

We deploy technical and organizational security measures to protect your data processed by us from accidental or wilful manipulation, loss, destruction or accessing by unauthorized parties. Our security measures are continuously improved in line with the state of the art.

We store your personal data on servers located in the European Union, the United States, Brasil, Singapore, Hong Kong and South Africa. If service providers are involved, personal data may also be transmitted to other countries subject to the applicable provisions of data privacy law.

Your rights

Upon request, we are happy to notify you of whether and which of your personal data we store. In the event that, despite our efforts on behalf of data accuracy and updated content, wrong information is stored, this will be corrected at your request. In your MyAirline Profile, you can yourself keep your information updated at all times.

Kindly update your personal data immediately after any change (e.g. your email address or phone number).

13. Integration of social networks

At various places on its websites and mobile applications MyAirline provides social network features. These include:

  • linking to MyAirline offers in social networks
  • forwarding and recommendation functions for MyAirline content (e.g. ‘Share’ and ‘Like’ buttons)
  • linking MyAirline offers with social networks, e.g. when you log in to your personalised area on myairline.com (‘social login’) All MyAirline’s online offers are essentially accessible and useable even without utilizing social networks. If you use the additional features, please note the following information about data handling:

Linking to MyAirline offers in social networks

Linking Myairline.com to one of our offers in social networks, e.g. to our Facebook page, involves simple links to other providers’ websites. With such a link, MyAirline does not transmit any personal information to this other provider. However, MyAirline would like to draw your attention to the fact that, in principle, the online offers of third parties are able to identify the source of a visit, at the very least. MyAirline has no influence over how third parties treat data; likewise, MyAirline’s Privacy Statement does not cover third-party websites.

Forwarding and recommendation functions for MyAirline content (e.g. ‘Share’ and ‘Like’ buttons)

At various places in MyAirline online offers MyAirline gives you the option of sharing and recommending its content on social networks. By doing so, MyAirline is offering you a convenient alternative to copying and sending links.

When you visit MyAirline pages and use the recommendation functions, MyAirline communicates the URL to the social network you have picked. A number of networks then immediately supplement the link with an excerpt of the content provided by MyAirline. With most social networks, you are asked for confirmation before this is saved or forwarded.

Please note that MyAirline has neither knowledge of nor influence on how social networks deal with the information you share with them and whether this information is made available to other websites. MyAirline recommends that you read their privacy policies carefully in each case.

Linking MyAirline offers with social networks

On MyAirline online offers MyAirline provides you with optional features, the use of which is connected to social networks such as Facebook, Twitter, LinkedIn or XING. If you use social networks, these features make it easier for you to use the MyAirline site.

At the same time, these features allow the MyAirline content to be adapted to your individual interests, e.g. to show you which of your contacts has already been to a certain destination and may perhaps be able to give you a few tips.

Social Login

‘Social login’ (also known as ‘social sign-in’) represents an enhancement of the traditional login to the MyAirline online offers. In place of your MyAirline Profile user-ID and password, you choose the preferred network with which you would like to be identified to MyAirline from a list of the various social networking services.

When you click on one of the buttons, a window from the selected network opens to ask you for your permission for MyAirline to access your personal profile. Depending on the network, you will also be told which information in your profile MyAirline is accessing as soon as you have given your permission for this.

Which profile information will be used?

As a rule, this information is your publicly available data in social networks, such as first name, surname, title/gender, date of birth, your relevant network identification number (UID), place of residence and country. Depending on the network and your existing privacy settings, this public information also includes your email address, the list of your friends and contacts, your interests (e.g. ‘Likes’) and your activities within the network in question. There is also the option of releasing further information if you expressly give your consent to this.

How will my data be processed – and for what?

MyAirline saves the profile information in a separate database so that it can identify you again on your next visit and can use this data on the MyAirline online offers – for example, in filling in forms and for simplified login on your next visit.

MyAirline also uses the data to match its product and information offer to your individual interests, i.e. for advertising and marketing purposes.

Will data from my MyAirline profile be used?

In order to be able to identify you quickly and clearly on your next visit to MyAirline offers, MyAirline assigns an anonymised user ID to the same database in which it also saves your profile information from your preferred social network. Personal information which you have entrusted to MyAirline remains with MyAirline and will not be transmitted to third parties.

Will my data go to third parties?

MyAirline uses your data from social networks solely to improve its own services on the web and in mobile MyAirline apps. Information is not passed to third parties provided that the service you use does not explicitly allow for this and that you have not consented to it.

Example: If you wish, for example, that MyAirline publishes the fact that you have checked in for your next flight in your name in your personal network on Facebook, this check-in information will be passed on to Facebook. This service would not be possible without a data transfer. MyAirline respects your privacy and handles your data carefully and transparently. That is why MyAirline recommends that all customers treat social networks sensibly and regularly check and adjust their privacy settings. Can I also delete the link to a social network? You can withdraw consent for access to your profile on a social network at any time in your personal profile on Myairline.com or in the relevant social network. If you do this, you also withdraw your consent for the use of this information for advertising and marketing purposes. As a rule, the profile information saved by MyAirline from the social network will be deleted within 24 hours.

MyAirline flight status

You can find out about the status of every MyAirline flight on the MyAirline website. In addition to the request on Myairline.com, you can also have flight status updates emailed to you or be notified via Facebook or Twitter.

Flight status via Facebook

If you select Facebook, the first time you use it a dialogue box will open up with a Facebook login button through which you give MyAirline permission to access your public profile and your friend list. You can also give MyAirline permission to post the flight status on your Facebook wall in your name. For this service MyAirline uses Facebook plug-ins (Facebook Inc., 1601 Willow Road, Menlo Park, California, 94025, USA). As soon as you have selected the notification option, this plug-in establishes a direct link between your browser and the Facebook server. As a result, Facebook receives the information that you have visited the MyAirline page with your IP address and can match your visit to your user account. MyAirline would expressly like to point out that it has no knowledge of the content of the transmitted data or of its use by Facebook. You will find further information about this in Facebook’s ‘Data Use Policy’. You can change or withdraw your consent for MyAirline access to your Facebook profile in the context of MyAirline flight status updates in your Facebook account settings.

Flight status via Twitter

As an alternative to receiving messages via Facebook, you can also receive flight status notifications via Twitter. As soon as you choose Twitter as your service, a page with a Twitter plug-in is displayed (Twitter Inc., Twitter, Inc. 1355 Market St, Suite 900, San Francisco, CA 94103, USA). By using Twitter, the websites you visit are linked with your Twitter account and made public to other users. In the process information will also be transmitted to Twitter. MyAirline would expressly like to point out that it has no knowledge of the content of the transmitted data or of its use by Twitter. You will find further information about this in Twitter’s ‘Privacy Policy’. You can change or withdraw your consent for MyAirline access to your Twitter profile in the context of MyAirline flight status updates in your Twitter account settings.

14. Transmission of Order Data to Governments

Many destination countries demand transmission of traveller data prior to departure (Advance Traveller Information): API (Advance traveller information): the collection and transmission of required traveller data A growing number of destination countries oblige airlines to forward traveller data to them for arriving in and departing from the country; some also require it from airlines flying over the country. Usually, such legal regulations involve the transmission of data on the identity and on the travel documents (passport, visa) of the travellers and crew on board the aircraft. As a rule, an airline does not have these data, so it must collect them shortly before an aircraft departs, which increasingly is being done by means of the so-called 'machine-readable zone' in the new travel documents. Collection of the data is done solely for immediate transmission to the authorities of the destination country. Extension of the API obligation in the European Union is planned over the next few years. The European Union's supervisory authorities for data protection confirmed that the data transmission provided for in this agreement was compatible with EU data protection regulations. The supplementing of API data in the case of Canada is similar to that for the USA In addition, Canadian law obliges airlines that fly to the country to supplement the data transmitted within the framework of API by those stored in certain fields of the reservation record (PNR) of the travellers involved. Canada and the European Union concluded an agreement to implement this legally prescribed transmission. The agreed content of the reservation record (as far as it is available) has been transmitted since the end of April 2006 as a supplement to the standard API data.

Personalized Boarding at London Heathrow

Heathrow Airport will track your location in the departure lounge by reference to where your boarding pass was last scanned and will furnish MyAirline with such data. This is in order to provide you with personalised boarding directions, to determine whether you will be late for your flight, and to ensure the security of travellers (including through sharing such information with UK authorities). TSA requires the transmission of certain traveller data prior to departure: The Transportation Security Administration (TSA) requires you to provide your full name, date of birth, and gender for the purpose of watch list screening, under the authority of 49 U.S.C. section 114, the Intelligence Reform and Terrorism Prevention Act of 2004 and 49 C.F.R parts 1540 and 1560. You may also provide your Redress Number, if available. Failure to provide your full name, date of birth, and gender may result in denial of transport or denial of authority to enter the boarding area.
